Description

Project Description: The work consists, in general, of installing two City owned trash capture CDS units and two City owned precast diversion structures, furnished by Contech, including lifting CDS unit in place, cutting into and connecting existing storm drain RCP's to CDS units, pouring two cast in place diversion weirs, installing manhole risers, shoring, excavation, and backfilling, bypass pumping and/or groundwater dewatering, construct two new driveways and a gravel pad for maintenance trucks, traffic control and such other items or details as required for a fully functioning trash capture device system as required by the plans, standard specifications, or these special provisions. The work is to be completed within ninety (90) working days. The CDS units and diversion structures will be pre-purchased by the City and furnished by the time of the installation. Contractor shall coordinate with Contech regarding the delivery schedule as well as the installation recommendations and drawing/specifications of the CDS units and diversion structures. The Contractor shall pay to the City of Hayward the sum of $3,000.00 per day in excess of the number of working days prescribed above, for each and every calendar day's delay in finishing the work. See details in the Special Provisions. At the time this contract is awarded, the Contractor shall possess either a Class A or Class C-34 license. When a construction contract is greater than $1,000,000, the contract is subject to the Community Workforce Agreement approved by the Hayward City Council on April 14, 2015. The successful bidder and all subcontractors, at any tier, will be required to sign an Agreement to be Bound which can be found in Exhibit G in the Special Provisions as a condition precedent to entering into any contract for this project. Pursuant to Section 1770 of the Labor Code, the Director of the Department of Industrial Relations has ascertained the general prevailing rate of per diem wages applicable to the work to be performed, which rates are filed in the office of the Engineer, and copies of which are available to any interested parties on request. In accordance with Labor Code Section 1771.1, a contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, or engage in the performance of any contract for public work unless currently registered with the State Department of Industrial Relations and qualified to perform public work pursuant to Labor Code Section 1725.5. Section 1771.1 applies to any bid proposal submitted on or after March 1, 2015 and/or any contract for public work entered into on or after April 1, 2015. Job Site Notices. Contractor shall post a Job Site Notice for this project pursuant to Title 8 California Code of Regulations Section 16451. The Contractor may elect to receive 100 percent of payments due under the contract from time to time, without retention of any portion of the payment by the City, by depositing securities of equivalent value with the City in accordance with the provisions of Sections 22300 of the Public Contract Code. All expenses of such substitute deposit shall be borne by the Contractor. Securities eligible for investment under the section shall include those listed in Section 16430 of the California Government Code or certificates of deposit of a bank or savings and loan association. The Contractor shall be the beneficial owner of any securities substituted for monies withheld and shall receive any interest thereon. Such securities, if deposited by the Contractor, shall be valued by the City's Finance Director (Treasurer), whose decision on valuation of the securities shall be final. Alternatively, upon the Contractor's request, the City will make payment of retentions earned directly to the escrow agent. The Contractor may direct the investment of the payments into securities, and the Contractor shall receive the interest earned on the investments upon the same terms provided for securities deposited by the Contractor. Upon satisfactory completion of the contract, the Contractor shall receive from the escrow agent all securities, interest and payments received by the escrow agent from the City, pursuant to the terms in Section 22300 of the Public Contract Code. The City of Hayward will not be a distribution point for the bid documents. The bid documents may also be reviewed at the various builders' exchanges and construction service offices throughout the San Francisco Bay Area. All questions about the meaning or intent of the Bidding Documents are to be submitted to City's project manager by email. Interpretations or clarifications considered necessary by City in response to bidder questions will be issued by Addendum delivered to all registered plan holders. Questions received less than 5 days prior to the date for opening of Bids may not be answered. Only questions answered by Addendum will be binding. Oral and other interpretations or clarifications will be without legal effect.
