Description

As of April 20, 2020 the project was awarded to McKinney Construction, Inc. for a total amount of $2,147,348.00. This do not have the anticipated start date at this time. The right is reserved by the City of Anahuac, Texas, as its interest may require, to accept or reject any or all bids, and to waive any informality in the bids received. For furnishing necessary materials, equipment, superintendence and labor for the City of Anahuac, Texas, Contract E - Water Line Replacement Project, TWDB DWSRF Project No. 62710, generally described as the construction of approximately 46,050 linear feet of 3 - 8 water line replacements, connections to existing water lines, approximately 426 water service line replacements, gate valves, fire hydrants, flush hydrants, bores, and various other improvements necessary for a complete installation. Bid Security, only in the form of: 1) a certified or cashier's check drawn on a Texas bank and made payable to the City of Anahuac, Texas; or 2) a bond executed by a surety company authorized to do business in Texas, in the amount of not less than five (5%) percent of the total bid, must accompany each bid at the time it is submitted. Bids must be submitted in duplicate. Bids may be held by the City of Anahuac, Texas for a period not to exceed 60 days from the date of the bid opening for the purpose of reviewing the bids and investigating the bidders qualifications prior to the contract award. Time for receiving bids is subject to change pending review and approval of the plans and specifications by the Texas Water Development Board. This contract is contingent upon release of funds from the Texas Water Development Board (TWDB). Any contract or contracts awarded under this Invitation for Bids are expected to be funded in part by financial assistance from the TWDB. Neither the U.S. Environmental Protection Agency (EPA) or the State of Texas, nor any of its departments, agencies, or employees are or will be a party to this Invitation for Bids or any resulting contract. Any contract(s) awarded under this Invitation for Bids is/are subject to the American Iron and Steel (AIS) requirements of federal law, including federal appropriation acts. This contract is subject to the Environmental Protection Agency's (EPA) Disadvantaged Business Enterprise (DBE) Program, which includes EPA-approved fair share goals toward procurement of Minority and Women-owned Business Enterprise (M/WBE) businesses. EPA rules require that prime contractors make a good faith effort to award a fair share of contracts, subcontracts, and procurements to M/WBEs through demonstration of six affirmative steps. Failure by the Contractor to carry out these requirements is a material breach, which may result in the termination of the awarded financial assistance. Attention is called to the fact that not less than, the federally determined prevailing (Davis-Bacon and Related Acts) wage rate, as contained in the contract documents, must be paid on this project. (a) All laborers and mechanics employed by contractors and subcontractors on projects funded directly by or assisted in whole or in part by and through the Clean Water State Revolving Fund or Drinking Water State Revolving Fund shall be paid wages at rates not less than those prevailing on projects of a character similar in the locality as determined by the Secretary of Labor in accordance with subchapter IV of chapter 31 of title 40, United States Code. (b) Pursuant to Reorganization Plan No. 14 and the Copeland Act, 40 U.S.C. 3145, the Department of Labor has issued regulations at 29 CFR parts 1, 3, and 5 to implement the Davis-Bacon and related Acts. Regulations in 29 CFR 5.5 instruct agencies concerning application of the standard Davis-Bacon contract clauses set forth in that section. All grants, cooperative agreements, and loans funded under the Clean Water State Revolving Fund and Drinking Water State Revolving Fund shall include the standard Davis-Bacon contract clauses found in 29 CFR 5.5(a), which shall also be incorporated in any resultant covered contracts that are in excess of $2,000 for construction, alteration or repair (including painting and decorating). Upon award, the successful bidder will be required to furnish payment and performance bonds.
