Description

P&Z Commission Meeting Date:5:30 p.m. on Monday, October 24, 2022 Council Meeting Date: 6:00 p.m. on Tuesday, November 15, 2022 Public Hearing: 6:00 p.m. on Tuesday, December 13, 2022. : Work on the improvement shall be commenced immediately upon approval of the contract by the Council, and be completed as stated below. Bid Security (Required): Each bidder shall accompany its bid with Bid Security as security successful bidder will enter into a contract for the work bid upon and will furnish after the award of contract a corporate surety bond, in a form acceptable to the City, for the faithful performance of the contract, in an amount equal to one hundred percent of the amount of the contract. 1. Bid Security shall be in the amount of (5%) five percent of total bid. 2. Bid Security shall be in the form of a cashier's check or a certified check drawn on an FDIC insured bank in chartered under the laws of the state of Iowa or on an FDIC insured bank chartered under the laws of the United States; ...or a certified share draft drawn on a credit union in Iowa or chartered under the laws of the United States; ...or surety bond written on an original AIA Document A310; ...or a bid bond on the form provided in the contract documents with corporate surety satisfactory to the City. The Bid Security shall contain no additional conditions either in the body or as an endorsement thereon, except as allowed by law. 3. Refer to Section 00 21 13 - Instruction to Bidders, 4. Refer to Section 00 22 14 - Supplemental Instruction to Bidders. Sales Tax Exemption: Contractors and subcontractors shall not include sales tax for material purchases. At the time of the contract acceptance by the City Council, the prime contractor and all subcontractors will be issued a certificate of exemption Title VI of the Civil Rights Act: The City of Urbandale, in accordance with Title VI of the Civil Rights Act of 1964, 78 Stat. 252, 42U.S.C. 2000d to 2000d-4 and Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office of the Secretary, Part 21, Nondiscrimination in Federally-assisted programs of the Department of Transportation issued pursuant to such Act, hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award. Performance and Payment Bonds Provisions: The successful bidder will be required to provide surety Performance and Payment Bonds in an amount equal to (100%) one hundred percent of the Contract Sum. 1. Said bond to be issued by a responsible surety and shall guarantee the faithful performance of the contract and the terms and conditions therein contained and shall guarantee the prompt payment for all materials and labor and protect and save harmless the City, from claims and damages of any kind caused by the operation of the Contractor. 2. Payment of the cost of said project will be made from any one or a combination of the following sources at the discretion of the Council: - Cash from such funds as may be legally used for said purpose. 3. Payments will be made to the Contractor based on monthly estimates in amounts equal to ninety-five percent (95%) of the contract value of the work completed, and will be based upon an estimate prepared on the first day of each month by the Contractor, subject to verification by Architect and the approval of the Clerk, who will certify to the Owner for payment of each approved estimate on or before the 10th day of the month in question. Such monthly payment will in no way be construed as an act of acceptance for any part of the work partially or totally completed. The balance of the five percent (5%) due the Contractor will be paid, subject to the conditions and in accordance with the provisions of Chapters 26 and 573 of the Code of Iowa, as amended. No partial or final payment will be due until the Contractor has certified to Owner, that the materials, labor and services involved in each estimate have been paid for in accordance with the requirements stated in the specifications Preference of Products: By virtue of statutory authority, a preference will be given to products and provisions grown and coal produced within the State of Iowa. Reciprocal Resident Bidder and Labor Force Preference: In accordance with Iowa law, a resident bidder shall be allowed a preference as against a nonresident bidder from a state or foreign country if that state or foreign country gives or requires any preference to bidders from that state or foreign country, including but not limited to any preference to bidders, the imposition of any type of labor force preference, or any other form of preferential treatment to bidders or laborers from that state or foreign country. The preference allowed shall be equal to the preference given or required by the state or foreign country in which the nonresident bidder is a resident. In the instance of a resident labor force preference, a nonresident bidder shall apply the same resident labor force preference to a public improvement in this state as would be required in the construction of a public improvement by the state or foreign country in which the nonresident bidder is a resident The Project consists of the construction of a new parks & public works unconditioned precast storage buildling to house bulk road salt, located on the same site as the new satellite maintenance facility building, including related site/ utility work Project Completion: Work shall commence upon issuance of written Notice to Proceed and be completed as set forth below: 1. Substantially Complete: within 12 months from written Notice to Proceed. 2. Fully Complete: within 13 months from written Notice to Proceed. 3. No liquidated damages on this Project. Printed Copies: Bidders for the Prime Contract may obtain printed copies of the Bidding Documents by contacting Beeline + Blue, Des Moines, IA, Ph. 515-244-1611 and depositing the sum of $100.00 [written to OPN Architects] or a MBI Plan Deposit card for each set of documents. Sub-bidders may obtain a maximum of one copy on the same basis. 1. Contractors and sub-bidders shall pay Beeline + Blue for associated shipping cost. 2. Deposit will be refunded to Bidders who return the Bidding Documents in good condition within fourteen days after award of project. The cost of replacement of missing or damaged documents will be deducted from the deposit. 3. A Bidder receiving a Contract award may retain the Bidding Documents and the Bidder's deposit will be refunded Copies of the contract documents are available online from the City of Urbandale website. Location - 5415 170th Street. Urbandale, Iowa 50323 The project consists of, but is not limited to, the construction of a new one-story unconditioned storage building to house bulk road salt. The building is used for storage only, of an accessory character to the existing maintenance facility on site. The structure is a combination of structural precast panels and precast double-t roof decking. Site work includes final grading, concrete approach apron, construction of necessary storm lines, and utility connections to tie into existing electrical services for a new power distribution system and lighting systems.
